The Ontario Energy Board amended the Distribution System Code (the “Code”) as indicated below, pursuant to section 70.2 of the Ontario Energy Board Act, 1998. The change to the Code means that bulk-metered residential condominiums will now be treated as residential customers for the purpose of consumer security deposits. The maximum applicable good payment history that an electric utility may require has therefore been reduced from either five years or seven years to one year. In order to qualify, the property of the customer must be a property as defined in the Condominium Act, 1998 and must also be a residential condominium corporation. For these revised security deposit rules to apply, qualifying electricity consumers must provide a signed declaration (this form) to their local electric utility attesting to their legal status as a residential condominium corporation.
